Most insureds do not realize that one of the most important documents in filing a property claim is a Sworn Statement in Proof of Loss. Most policies require that a Proof of Loss be filed within sixty days of a loss or within sixty days of being requested by the insurance company on fire and water claims. Failure to file may mean denial of your claim. You should read your policy to make sure. This stipulation is generally found in the section “Duties to the Insured”

I have been asked many times what is and why are in insurance companies requesting and exam under oath. An examination under oath is an insurance companies way of attempting to gather information from an insured to not pay their claim. It is as simple as that. An insurance company has a right under the policy and will frequently ask for an exam under oath when they want to be difficult. An insured has the right to be represented during the process and should further explore those options.

Michigan Association of Public Insurance Adjusters had a meeting March 9th in Farmington Hills. The discussion revolved around the new residential public adjusting agreements adopted by OFIR. We are in the process of scheduling another meeting sometime in the nears future.
